Leave - Military
The St. Charles City-County Library District provides military leave for eligible employees in accordance with the Uniformed Services Employment and Reemployment Rights Act (USERRA) of 1994 and Missouri Revised Statutes.
Any permanent full time or part time employee who is a member of the National Guard or any of the Reserve units of the Armed Forces of the united States will be granted a leave of absence from his/her duties without loss of time, pay or any other benefits when proof of military orders is presented.
Employees shall notify their immediate supervisor as soon as they are aware of the need for military leave. A copy of the military orders must be presented to the supervisor along with a written leave request before the military leave will be approved.
The maximum amount of pay for military leave is 120 hours or fifteen (15) calendar days per calendar year. If additional leave in excess of 120 hours or fifteen (15) calendar days is required, the employee shall request an extension and shall cover the additional time with annual leave or leave without pay according to those policies.
For example, if a full time employee, normally scheduled to work Tuesday through Saturday, has military duty from Tuesday, October 1 through Tuesday, October 15, the employee will be paid for the working days that fall within that period, i.e., 11 days.
If a part time employee is on military leave for 15 days and during that time is only scheduled to work 48 hours, the employee will be paid for 48 hours at his/her regular rate of pay. If the same employee is on military leave for 20 days, the District will only pay for the number of work hours scheduled during the first 15 days. For the additional 5 days, the employee will need to use another form of leave, i.e., annual or holiday.
For weekend Reserve training, the employee will notify his supervisor of the training schedule as soon as the schedule is received so that the supervisor can arrange the work schedule to allow time off for the military training.
In case of unpaid military leave of absence exceeding 30 days, the employee may continue benefit coverage by paying the full cost of coverage (both the employee and the employer premiums). If the employee chooses to suspend benefit coverage, the employee will be eligible for reinstatement of benefits upon returning to work.
Upon discharge from active duty, an employee on approved Military Leave must apply for re-employment within the following time limits:
The returning employee will be re-employed in the job they would have attained had they not been absent for military service with the same seniority, status, and pay, as well as other rights and benefits determined by length of employment. Reasonable efforts will be made to provide any necessary training to the returning employee.
